These terms govern your use of giftloft.com and any order you place through it. Placing an order means you accept them.
Orders
An order is an offer to buy. It is accepted when we send you an order confirmation. We may decline an order, and will tell you why, if an item is unavailable, if we cannot ship to the address, or if we suspect fraud.
We try hard to keep product descriptions and photographs accurate. Contents of curated boxes may vary slightly where a supplier is out of stock. Where that happens we substitute an item of equal or greater value in the same spirit, and for bulk orders we ask you first.
Pricing and payment
Prices are in US dollars and exclude sales tax and shipping unless stated. Payment is taken at checkout for standard orders. Orders of 25 units or more may be invoiced on Net 30 terms where agreed in writing. Overdue invoices may accrue interest at 1.5 percent per month.
If a price is listed in obvious error, we are not obliged to honour it. We will contact you and offer to cancel or reprice.
Bulk and custom orders
Bulk orders are governed by the quote we issue, which sets out quantity, unit price, delivery window and cancellation terms, and which prevails over these terms where the two conflict. Custom and bespoke builds require written approval of the specification before production begins. Once production begins, custom orders cannot be cancelled.
Gift messages
You are responsible for the content of any message you ask us to write. We will decline to write messages that are unlawful, harassing or hateful, and we will refund the order if we do.
Shipping, delivery and returns
Shipping timelines, scheduled delivery, damaged goods and cancellations are covered on Shipping and Returns, which forms part of these terms. Risk passes on delivery to the address you gave us.
Intellectual property
The Gift Loft name, logo, site design, photography and written content belong to Gift Loft and may not be copied or used commercially without permission. Where you supply artwork for branding, you confirm you have the right to use it and you permit us to reproduce it for your order.
Liability
Nothing here limits liability that cannot lawfully be limited. Subject to that, our total liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss, including loss of business or reputation arising from a delayed delivery.
Accounts
You are responsible for keeping your account credentials secure and for activity under your account. Tell us promptly if you believe your account has been compromised.
Governing law
These terms are governed by the laws of the State of Utah, and disputes are subject to the courts of that state.
Changes
We may update these terms. The version in force when you place an order is the version that applies to it.
